Terms and Conditions for the E-Marketing Afran Company, a single-person company operating the E-Marketing Afran application.
For shops and productive families

Please read and understand this before contracting or using our services. When you set up your Afran account, you agree to these terms, which will take effect from the date of subscription and membership commencement and will remain in effect until your membership is cancelled by you or Afran. These terms constitute a legally binding agreement between you and Afran. This agreement governs your use of the Afran applications, website, call center, and technology platform (collectively, the "Afran Platform").

Information about Afran

Afran E-Marketing Company, Commercial Registration No. 1010577497, Unified Establishment Number 7009016481, does not sell or interfere in any way with the production, manufacturing, or preparation of any food produced by productive families or stores. It provides marketing services on behalf of third parties to productive families or other stores. This website was created to be the largest comprehensive online gathering of productive families and stores. What this application offers to users is merely providing and facilitating the ability to search and locate productive families and local stores participating in the Afran application and approved by other government agencies via the Internet. All items, materials, and products of productive families, restaurants, and partner stores are displayed on the website for customers, allowing Afran customers to order the items they specify and then carry out the delivery task, called the "Service." Afran acts as an agent on behalf of this producing family, restaurant or partner store to complete your order through the system and application, and manage your experience throughout the ordering process. Once you have completed the order, your items will be delivered to your location map approved by Afran based on the restaurant or partner store you have selected. These stores are solely responsible for adhering to the laws, regulations, rules, standards and criteria applied in the Kingdom of Saudi Arabia, such as those related to the preparation, preparation, sale, marketing and safety of food, knowing that the store will take all possible means it can do to meet the specified delivery time. Definitions

Refers to Afran. It is an online marketing platform on behalf of others, allowing users to order food and products from productive families or registered stores and restaurants. The purpose of this site is to provide a simple and convenient service to customers, connecting them with productive families and stores in their area.
User: Any person who registers and uses the Application to request Services.
Merchant/Productive Family/Restaurant/Shop: Any commercial entity or individual registered on the application to display and sell its products.
Captain/Delegate: The person responsible for delivering orders to users.

Application Terms of Use

1- The merchant/productive family acknowledges that he/she has the legal capacity to use the application and conclude electronic contracts.

2- It is prohibited to use the application for any illegal or fraudulent purposes.

3- The administration has the right to suspend or cancel the account of any merchant/productive family proven to have misused the application for any reason without notifying them.

Account registration

1- The merchant pledges the accuracy of the information provided to Afran Company, which authorized him to accept and register in this application, and that Afran Company disclaims any responsibility for any incorrect information provided. In the event that incorrect information is provided that may harm Afran Company or its reliability with others, Afran Company has the right to suspend the account or cancel the registration, with Afran retaining all the dues of the merchant or user and compensation for the damage.

2- The merchant/productive family undertakes to provide accurate information upon registration, including name, phone number, email, address, bank account, and other government licenses. The merchant and the productive family are responsible for its accuracy.

3- The merchant/productive family is responsible for maintaining the confidentiality of his account data and password and agrees to accept responsibility for all activities that occur with his permission in relation to his Afran application account. In the event that the password is lost or stolen, or there is suspicion of unauthorized access to his Afran account, the merchant/productive family or restaurants and stores are required to notify Afran Company immediately and change the password on the Afran application as soon as possible.

4- The merchant/productive family is committed not to use any other account for his own account and will be responsible for any action or damage that occurs to Afran or users, and Afran is not responsible for any other losses that occur, unless the person using your password obtained it due to a technical malfunction in Afran.

5- The merchant/productive family may permanently close the account at any time by requesting to do so in the “Your Account” section of our website or by contacting us using the contact information provided above after settling the amounts due to Ovens.

6- If there is a problem with the bank account or the merchant/productive family wishes to change the bank account, the customer service of the partner stores must be contacted directly on the unified number (920031738) or via email [email protected].

Fees for shops and productive families

1- The merchant/productive family is obligated to pay 20% of the total value of each order placed through the Afran application to Afran Company via the approved bank account of Afran, whether the delivery service is provided by Afran or by the user receiving it at the merchant’s location. This percentage may be subject to change later, and Afran reserves the right to impose additional prices and fees.

2- The amounts charged to the productive family will be increased if the bank increases the fees for purchases made with a Visa, MasterCard, or any other credit card.

3- The merchant/productive family is obligated to pay 20% of each order to Afran Company if the user does not pay electronically and chooses to pay upon receipt within a maximum period of three days to the official and approved bank account that Afran will provide to the merchant/productive family upon registration. In the event that the merchant does not commit to payment, Afran has the right to suspend the account and suspend any amounts due to the merchant and impose a fine according to Afran’s internal policy.

4- The merchant/productive family is obligated to pay an amount of (5 riyals) for each money transfer executed in his favor, and this amount is deducted from the total value of the transfer.

5- Transfers with a value less than (100 Saudi Riyals) will not be accepted, and it is required that no financial transfer less than this limit will be executed.

Electronic payment fees for stores and productive families

The store and the productive family agree to bear the fees incurred for using electronic payment methods, according to the following:

  1. MADA Service: A fee of 0.8% of the value of each transaction is charged.
  2. Credit Cards: A fee of 2% of the value of each transaction is charged, in addition to a fixed fee of 1 riyal for each transaction.
  3. Apple Pay via Mada: A fee of 0.8% of the transaction value is charged.
  4. Apple Pay via credit card: A fee of (2%) of the value of each transaction is charged, in addition to a fixed fee of (1 riyal) for each transaction.
  5. STC Pay: A fee of 0.9% of the value of each transaction is charged.

Afran’s obligations

  1. Afran is committed to transferring the total value of orders after deducting 20% ​​of the total value of each order and deducting any other dues from the merchant or other fees once a week to transfer the dues. If the dues are transferred multiple times within a week, it is not binding on Afran and after that, it is contrary to the agreement.
  2. The amounts due to the merchant/productive families will be transferred after the specified percentage for the Afran has been met and any amounts owed to the merchant/productive families will be settled into the bank account approved upon registration and reserved for the merchant only. No amounts will be delivered in cash or transferred to another account for any reason.

Delivery and pickup

  1. The Merchant is committed to delivering orders specified by the User to the Productive Families by receiving them from the Merchant’s website at the specified time and based on the order conditions.
  2. The merchant/productive family is committed to delivering the order according to the standards and quality specified in the Afran application. In the event of a violation of any of the terms, Afran has the right to impose a fine according to Afran’s internal policy.
  3. The merchant/productive family is committed to delivering orders to the delivery captain on time, based on the order conditions, and in accordance with the criteria specified in the Afran app.

Cancellation and Refund Policy

1- In the event that a user’s order is accepted and then cancelled due to unavailability or for any other reasons related to the merchant and the productive families, Afran has the right to deduct the full value of the order and impose a fine on the merchant/productive families according to Afran’ internal policy.

Responsibility related to (productive family/restaurant/store)

1- The producing family/restaurant/store pledges the accuracy of the information provided to the user, whether ingredients, quality, cooking method, or any related products, and that “Afran” will not be obligated or responsible for any food or services provided by stores that are unhealthy, cause injury or exposure to allergies, are unacceptable to buyers, or do not meet buyers’ expectations in any way.

2- The producing family/restaurant/store is committed to the laws and regulations in force in the Kingdom of Saudi Arabia for food preparation. Also, Afran Company does not guarantee that the menu displayed on the website by the store or the producing family matches what is actually provided to users, and this responsibility falls solely on the store.

3- “Afran” does not guarantee in any way the quality or type of any food, or that the food is not in compliance with applicable laws and regulations, nor does it guarantee that the menu displayed on the website matches what is actually provided to users, and the producing family or store is responsible for what it provides.

4- The store is committed to ensuring that food preparation is carried out in accordance with special standards such as “organic,” “macrobiota,” and special allergy standards such as “fungus-free,” “gluten-free,” or “lactose-free.” However, Afran does not independently verify or confirm these commitments.

5- In the event that the merchant fails to provide the information to the user, for example, but not limited to (submitting an order that is different or incomplete than what the customer requested, or submitting a damaged, expired, or non-compliant order, or one that harms the user), Afran has the right to deduct the value of this order in addition to an estimated compensation for the user, estimated by the officials at Afran according to the internal policy of Afran, and Afran reserves the right to compensate the merchant for the exposure of his reputation, trust, and credibility with users.

6- The producing family/restaurant/store is committed to ordering well and in accordance with the standards and quality followed in the Kingdom of Saudi Arabia and ensuring that orders are delivered to the delivery captain in a sealed form to ensure that they reach the user in good condition. Afran has the right to impose a fine according to Afran’ internal policy when delivering any order without packaging.

General Provisions

1- Failure to impose a fine for any of the terms will not constitute a waiver of Afran’s right to apply these fines later or any other provisions of the terms, and Afran has the right to demand or add them whenever it wishes.

2- Afran Company reserves the right to provide you with offers and benefits such as discounts, special events, and promotions. Any such offers or benefits will be subject to the terms and conditions that will be notified to you.

3- All intellectual property rights in the contents of the Afran application are owned by Afran Electronic Marketing Company, its affiliates or its licensors and are protected by copyright, trademarks and other applicable laws.

Amendments to the Terms and Conditions

1- Afran has the right to amend these terms at any time, and subscribers from stores/productive families will be notified of the changes through updates within the application.

Privacy and Data Protection

1- The platform collects your personal information and interaction data on the platform to develop and improve the services provided.

2- Transfer this data to any entity to which the operating rights are transferred as needed.

3- Sharing this information with partners who provide data analysis and marketing services to the extent necessary.

4- Sharing this information with law enforcement agencies in response to legal requests they may receive.

5- Sending customized and marketing alerts, messages, and notifications to platform users via text messages, email, website and app alerts.

6- You agree that Afran and any of its affiliated companies will collect, use, store, transfer and process your personal data for the purposes mentioned in these terms and primarily described in the Privacy Policy. All data processing activities will comply with the “Personal Data Protection Law” in the Kingdom of Saudi Arabia, ensuring that your data is handled securely and legally.

Termination by "Afran"

1- Afran may terminate the membership of subscribers from its productive stores/families at its discretion without any prior notice, if it determines, in its discretion, that you are violating these terms or any applicable law, including fraud or abuse of membership, or that it harms the interests of Afran or others or the interests of other customers.

Applicable law in case of dispute

These terms are subject to the laws in force in the Kingdom of Saudi Arabia, and any dispute arising shall be resolved through the competent judicial authorities in the city of Riyadh.
