Afran for Electronic Marketing, Commercial Registration No. 1010577497, and the unified establishment number 7009016481, does not sell or interfere in any way in the production, manufacture, preparation, or supervision of any food produced by productive families or stores. It provides marketing services on behalf of third parties to productive families or other stores. What this application offers to users is merely providing and facilitating the ability to search and find productive families and local stores participating in the application and approved by other government agencies. These stores are solely responsible for adhering to the laws, regulations, systems, standards, and criteria applied in the Kingdom of Saudi Arabia, such as those related to the preparation, sale, marketing, and safety of food, knowing that the store will take all possible means it can do to meet the specified delivery time. Definitions
Refers to Afran. It is an online marketing platform on behalf of others that allows users to order food and products from productive families or registered stores and restaurants. The purpose of this website is to provide a simple and convenient service to customers and connect them with productive families and stores in their area. User: Any person who registers and uses the application to request services. Merchant/Productive Family/Restaurant/Shop: Any commercial entity or individual registered on the application to display and sell their products. Representative: The person responsible for delivering orders to users.
Application Terms of Use
1- The user acknowledges that he has the legal capacity to use the application and conclude electronic contracts.
2- It is prohibited to use the application for any illegal or fraudulent purposes.
3- The administration has the right to suspend or cancel the account of any merchant or user proven to have misused the application for any reason without notifying him.
Account registration
1- The user pledges the accuracy of the information provided to Afran Company, which authorized him to accept and register in this application, and that Afran Company disclaims any responsibility for any incorrect information provided. In the event that incorrect information is provided that may harm Afran Company or its reliability with others, Afran Company has the right to suspend the account or cancel the registration, with Afran Company retaining all the dues of the merchant or user and compensation for the damage.
2- The user undertakes to provide accurate information upon registration, including name, phone number, email address, and address, and the user is responsible for its accuracy.
3- The user is responsible for maintaining the confidentiality of his account data and password and agrees to accept responsibility for all activities that occur with his permission in relation to the user’s Afran application account. The user is required to notify Afran Company immediately and change the password on the Afran application as soon as possible.
4- Users alone are responsible for verifying the accuracy of delivery addresses, and Afran Company or the stores will not have any obligation or responsibility for any incorrect addresses.
Orders and Payment
1- All prices listed in the application include applicable taxes and fees, which appear in the total before payment.
2- Payment is made through the payment methods available in the application (credit cards, cash on delivery, electronic wallets).
3- The user has no right to cancel the order after it has been accepted by the producing family/partner stores.
4- All our productive families and partner restaurants/stores decide their own working hours. This means that the availability of their services, and the range of restaurants/stores from which you can order, depends on the partner restaurants/stores in your area.
5- The balances available within the user’s application wallet for future use are considered valid, taking into consideration the duration of the balance benefit, which is considered under the company’s policy as a future reference for your application wallet balance, as we provide a policy that takes basic considerations in terms of the source of the balance in question, which is explained in the following figure:
1) The credit will be considered valid and effective if the amount is added to your application wallet via a successful financial deposit from any bank or electronic transfers directly from you, until it is used in the future through the company’s services at any time.
2) All temporary balances of the wallet by the company for reasons of improving the quality of service or compensation to the customer, the balance available in the wallet remains valid for use and is valid for a period of “30” thirty days only from the date of depositing the balance by the company, and then the balance is deleted completely without obligation to notify or any future compensation.
3) All available balances in the working wallet, which are sourced from the company, as a result of providing special sales offers or promoting marketing services (“marketing balances”) or the like within the framework of the customer’s use of the services available on the application, for a specific period of time not exceeding (15) fifteen days from the date of deposit, and then all available balances for use are deleted without notifying the customer directly (“marketing balances from the company only”) and without any responsibility after the end of the right to use the marketing balance.
Delivery, pickup and service availability
1- The delivery time is determined based on the user’s location and the order conditions.
2- The representative is committed to delivering the order according to the address and time specified in the application. In the event that the user is not present at the specified address and the user is unable or delayed receiving the order, the user shall bear all costs.
3- If the user chooses to receive directly through partner stores/productive families, Afran Company will not have any obligation or responsibility other than for comments or complaints related to the order.
4- In the event that the order is not received or there is any problem with the order, Afran must be notified via the communication channels and customer service within a maximum period of 24 hours, otherwise the user will forfeit his right to claim and receive compensation.
5- Each partner restaurant and store operates from its own specific delivery area, as described in the Afran app. This delivery area may change at any time due to factors such as weather or high traffic on services.
Products
1- The producing families or partner restaurants/stores may use organic materials, nutritional supplements, or other allergens in the preparation of some food items or non-compliant products. Please contact the producing family or partner restaurant/store before ordering if you suffer from allergies. Afran cannot guarantee that any of the products sold by our partner producing families/restaurants are free of allergens or the stores concerned with those ordered products.
2- When placing any order through the application, it must be confirmed so that it is accepted by us or the producing family, restaurant or partner store. If your order is accepted, all products are subject to availability and the user is responsible for paying for all ordered products using his own account, for the related delivery fees, and for complying with these terms, even if the user has ordered the products for someone else through his personal account.
3- The user is responsible for completing payment once the order is submitted and accepted by the producing family or participating restaurant/merchant. If payment is not made, the account may reflect a negative balance. Afran reserves the right to block accounts with negative remaining balances and, in some cases, may take additional measures to legally recover unpaid amounts.
4- When placing an order for a product, we will have the option to place it as delivered and we will explain the tracking of your order according to the procedures until the estimated delivery time for your product through the order placement, and we will try to deliver as soon as possible; therefore, the user must be available to accept receipt from the time the user places the order in the application.
5- Despite our best efforts at Afran and the best efforts of the productive families/partner stores, things may not always go according to the delivery plan specified at the time of ordering and may be characterized by factors such as traffic and/or weather conditions that may prevent us from delivering the order on time. If your order is delayed by more than 120 minutes, and we did not inform you of giving you the option to cancel your order, you are entitled to compensation at the discretion of Afran according to Afran’s internal policy, unless the user caused the delay (for example, because you provided us with the wrong address or did not come to the specified location to receive the order).
6- “Afran” does not guarantee in any way the quality or type of any food, or that the food is not in compliance with applicable laws and regulations, nor does it guarantee that the menu displayed on the website matches what is actually provided to users, and the merchant, the producing family, or the store is solely responsible for what it provides.
Responsibility related to (productive family/restaurant/store)
1- The application works as a marketing tool for productive families/restaurants/other stores and does not bear any responsibility for the quality of food or products, and this responsibility lies solely with the store.
2- Afran Company does not guarantee that the menu displayed on the website by the producing family or the store matches what is actually provided to users, and this responsibility falls solely on the store.
3- Afran Company has the right to deduct the order amount and not refund it to the user in the following cases:
- Wait for the delivery representative or captain at the customer's location and attempt to communicate with the customer for no more than 10 minutes from the time of arrival.
- The delivery representative/captain is not allowed to enter the customer’s location for security reasons (military area, hospital, university, hotel, private residence).
- Change in customer address after the time allowed for cancellation or modification of the order by the customer has expired.
Price and payment to the user
1- The way our product prices are displayed may vary depending on the producing family/merchant, and in accordance with applicable regulations. The prices displayed on the application are valid only at the time of each order and may be subject to change later. “Afran” reserves the right to impose additional prices and fees (including, but not limited to, delivery fees, small order fees, or service fees) on orders placed through the application. These fees are displayed when you place your order on our services. Details of the prices and additional fees are displayed to the customer before completing the payment process. When you place your order, you agree to all amounts, additional fees, and the final total amount displayed. The service fees and other fees that “Afran” may subsequently apply to all orders placed through the application will be applied to all orders placed through the “Afran” platform without any exceptions. The service fees are non-refundable in whole or in part, except in cases of failed orders that were not accepted only. “Afran” reserves the right to amend the value of the service fees as it deems appropriate.
Cancellation and Refund Policy
1- The order cannot be cancelled after it has been completed and accepted by the store/productive family and the due amount has been paid.
2- In the event of receiving an incorrect or defective order, the user has the right to request a replacement or refund due to the error of the producing family/restaurant/store in accordance with the internal policy of Ovens.
Amendments to the Terms and Conditions
1- Afran has the right to amend these terms at any time, and subscribers from stores/productive families will be notified of the changes through updates within the application.
Privacy and data protection. By using the platform, you agree to:
1- The platform collects your personal information and interaction data on the platform to develop and improve the services provided.
2- Transfer this data to any entity to which the operating rights are transferred as needed.
3- Sharing this information with partners who provide data analysis and marketing services to the extent necessary.
4- Sharing this information with law enforcement agencies in response to legal requests they may receive.
5- Sending customized and marketing alerts, messages, and notifications to platform users via text messages, email, website and app alerts.
6- You agree that Afran and any of its affiliated companies will collect, use, store, transfer and process your personal data for the purposes mentioned in these terms and primarily described in the Privacy Policy. All data processing activities will comply with the “Personal Data Protection Law” in the Kingdom of Saudi Arabia, ensuring that your data is handled securely and legally.
Termination by "Afran"
1- Afran may terminate the membership of its subscribers and users at its discretion without any prior notice, if it determines, in its discretion, that you are violating these Terms or any applicable law, including fraud or abuse of membership, or that it is harmful to the interests of Afran or others or to the interests of other customers.
Applicable law in case of dispute
These terms are subject to the laws in force in the Kingdom of Saudi Arabia, and any dispute arising shall be resolved through the competent judicial authorities in the city of Riyadh.
